Notice is hereby given that a Regular Meeting of the City Council of the City of Lucas will be held on Thursday, March 6, 2008, at 7:00 PM at the Lucas City Annex, 185 Country Club Road, Lucas, Texas, at which time the following Agenda will be discussed.

Citizen Input

The Mayor and City Council invites citizens to speak on any City business item. In accordance with the Open Meetings Act, comments of public interest will be heard, but no action may be taken by the City Council other than to refer the item to a future agenda. Please complete and submit to the City Secretary a “Request to Speak” sheet prior to the meeting.

 

1) Citizen’s Comments.

 

Public Hearings

The Public Hearing agenda is provided for the purpose of allowing citizens to ask specific questions regarding only the subject posted for the Public Hearing. Generally the Public Hearing is required by State Law and a record of those attending the Public Hearing is maintained as part of the official record of the proceedings.

 

2) Public Hearing/Discuss and Consider an petition filed by Claremont Springs, II,

LTD requesting the City annex described as situated in Collin County, Texas, and being part of a called 46.892 +/- acres tract of land situated in the J. Snider Survey, Abstract No. 824 in the City of Lucas described in Clerks File No. 05-0169490 of the deed of records of Collin County, Texas, commonly known as Claremont Springs Phase II. [1st Public Hearing]

 

Consent Agenda

Items placed on the Consent Agenda are considered routine in nature and are considered non-controversial. The Consent Agenda can be acted upon in one motion. A majority vote of the Council is required to remove any item for discussion and separate action. Council members may vote on any single item without comment and may submit written comments as part of the official record.

 

3) Consent Agenda:

 

a) Approve the minutes from the February 7th Regular, February 7th Special,

February 11th Special and February 21st Workshop Meetings. [Wingo]

4) Collin County Commissioner Joe Jaynes to present a check to the City of Lucas in the amount of $82,587.50 an award from the Collin County Matching Funds Grant.

 

5) Discussions and questions from citizens regarding the proposed Home Rule

Charter.

 

6) Discuss and Consider the approval of an ordinance of the City of Lucas,

Texas, amending the Code of Ordinances of the City of Lucas by amending

Chapter 8, “Offenses and Nuisances” by adding a new Article 8.05 titled

“Noise”; providing a repealing clause; providing a savings clause; providing a

severability clause; providing for a penalty; and providing an effective date.

7) Discuss and Consider the approval of a contract with Mr. Sweeper to power

sweep City roads chip sealed in 2006. [Caudell]

 

8) Discuss and Consider the approval of the contract with the Collin County

Elections for election services concerning the May 10, 2008 General and

Special Elections. [Wingo]

 

9) Discuss and Consider the approval of a request for sidewalk waiver submitted

by Mr. Robert H. Holmes II regarding the 20 one acre lots with a 32’ wide street

commonly known as The Reserve at Forest Grove is in the G. Fitzhugh Survey,

Abstract No. 318, City of Lucas, Collin County, Texas.

Executive Session
The City Council may convene in Executive Session in accordance with the Texas Government Code. All decisions regarding the discussion of the Executive Session must be made in Open Session.

 

11) City Council pursuant to §551.071 of the Texas Local Government Code may

convene into Executive Session regarding the litigation between John Spencer,

Matt A. Freeman, Mary J. Freeman ET AL and the City of Lucas and Seis

Lagos Utility District.

12) Take any action as necessary from the Executive Session.

 

13) Adjournment.

As authorized by Section 551.071 (2) of the Texas Government Code, the City Council may

convene into closed Executive Session for the purpose of seeking confidential legal advice from the City Attorney regarding any item on the agenda at any time during the meeting.
