Citizen Input
The
Mayor and City Council invites citizens to speak on any City business item. In
accordance with the Open Meetings Act, comments of public interest will be
heard, but no action may be taken by the City Council other than to refer the
item to a future agenda. Please complete and submit to the City Administrator a
“Public Meeting Appearance” sheet prior to the meeting.
1) Citizen’s Comments.

of the City business.

Consent Agenda
The
Consent Agenda is used to increase the efficiency of time. All items listed
under the Consent Agenda may be considered by a single motion, second and
passage by a majority vote of the Council present at the time of consideration.
Any member of Council may remove an item from the Consent Agenda prior to a
motion to act upon the agenda.
3) Approve the minutes from the November 16, 2006 City Council Workshop Meeting and the December 7, 2006 City Council Regular Meeting.
4) Consent to accept the resignation of the Municipal Court Judge, Elizabeth Frizell.
5) Consent to approve a
resolution appointing a Municipal Court Judge for a two year term and to
authorize the Mayor to execute a contract, after approval by the City Attorney,
to provide for compensation and terms of appointment.
6) Discuss and Consider the resignation of Council Member Tonda Frazier submitted on December 19, 2006 to be
effective January 31, 2007.
Public Hearing
The Public Hearing agenda is provided for the purpose of
allowing citizens to ask specific questions regarding only the subject posted
for the Public Hearing. Generally the Public Hearing is required by State Law
and a record of those attending the Public Hearing is maintained as part of the
official record of the proceedings.
7) Public
Hearing/Discussion/Action on the adoption of an ordinance of the City of Lucas,
Collin County, Texas amending the Code of Ordinances by amending Chapter 13,
Article 13.06, Solid Waste, by adding Section 13.06.034, Subsection (a) through
(e) to provide for roll-off containers; providing for roll-off containers on
residential lots; providing a permit requirement; providing for permit
extensions; prohibiting use by any person other than the owners, permittee or persons contracted to use said roll-off
container; providing for a fee to be established by resolution of the city
council; by reserving Sections 13.06.035 through 13.06.060; repealing
provisions in conflict; providing a severability clause; providing for a
penalty not to exceed two thousand dollars ($2,000.00) for each offense; and
providing an effective date. [2nd Public Hearing, 1st Public
Hearing held on December 7, 2006]

8) Discuss and Consider the audit for the Fiscal Year 2005 – 2006.
9) Discuss and Consider the year end reports as presented by City Administrator
Charles Fenner.
10) Discuss and Consider the appointment of Matt Kolodzie
to the Parks and Open Space Board as a regular member and moving Richie Wolfe
to an alternate member.
11) Discuss and Consider to approve a resolution establishing a Master Fee
Schedule for the City of

Consider the Capital Improvement Project list.
13) Discuss and Consider an amendment to Ordinance # 2006-07-00567
Subdivision and Development Regulations, Section 6.403, Streets and Drainage,
Item 3 a-d, regarding sidewalk regulations.
14) Discuss and Consider the application request for preliminary plat. Jed Dolson, representative of Skorburg,
is requesting the approval of a preliminary plat for 46.892 ± acres
located in the J. Snider Survey abstract NO. 824 and
15) Discuss and Consider all City owned property.
16) Discuss and
consider amending ORDINANCE 1996-01-00323 AND THE code of ordinances, BY
AMENDING ARTICLE 1.04 “CITY OFFICERS”, SECTION 1.04.034
“POWERS AND DUTIES”, BY amending subsection (1) to provide for
compliance with state law and by adding subsections (4) through (6) to provide
additional duties for the city administrator; and by adding a new section
1.04.036 to provide for city council direction; Repealing provisions in
conflict; providing a Severability clause; and providing an effective date.
Executive Session
The City Council may convene in Executive
Session in accordance with the Local Government Code. All decisions regarding
the discussion of the Executive Session must be made in Open Session.
17) City Council
pursuant to §551.072 of the Texas Government Code may convene into
Executive Session regarding the purchase, lease, and sale of property.
18) City Council
pursuant to §551.071 of the Texas Government Code may convene into
Executive Session regarding the litigation between Buzznet,
Inc. and the City of Lucas and lease by and between Buzznet,
Inc. and the City of Lucas.
19) City Council
pursuant to §551.074 of the Texas Government Code may convene into
Executive Session to deliberate the duties and assignment of such of the City
Administrator, City Secretary, Finance Manager, Mayor, and City Council.

20) Take any
action as necessary from the Executive Session.
Routine Business
21) Discussion
and consideration for items to be placed on a future agenda.
22) Adjournment.
As authorized by Section 551.071 (2) of the Local Government
Code, the City Council may convene into closed Executive Session for the
purpose of seeking confidential legal advice from the City Attorney regarding
any item on the agenda at any time during the meeting.
