Notice is hereby given that a Regular Meeting of the City Council of the City of Lucas will be held on Thursday, December 7, 2006, at 7:00 PM at the Lucas City Annex, 185 Country Club Road, Lucas, Texas, at which time the following Agenda will be discussed.

The Mayor and City Council invites citizens to speak on any City business item. In accordance with the Open Meetings Act, comments of public interest will be heard, but no action may be taken by the City Council other than to refer the item to a future agenda. Please complete and submit to the City Administrator a “Public Meeting Appearance” sheet prior to the meeting.

Consent Agenda

The Consent Agenda is used to increase the efficiency of time. All items listed under the Consent Agenda may be considered by a single motion, second and passage by a majority vote of the Council present at the time of consideration. Any member of Council may remove an item from the Consent Agenda prior to a motion to act upon the agenda.

            3) Approve the minutes from the October 16, 2006 City Council Workshop Meeting.

 


            4) Approve an amendment to Chapter 7 “Water System Regulations”, Article 10 Drought Contingency Plan, Section 10-2, Item 7 (i) permits for construction of private pools and Item 7 (j) prohibition of new landscaping to be moved from Stage 3 Severe to Stage 4, Emergency conditions.

 

Public Hearing

The Public Hearing agenda is provided for the purpose of allowing citizens to ask specific questions regarding only the subject posted for the Public Hearing. Generally the Public Hearing is required by State Law and a record of those attending the Public Hearing is maintained as part of the official record of the proceedings.

            5) Public Hearing/Discussion/Action on the adoption of an ordinance of the City of Lucas, Collin County, Texas amending the Code of Ordinances by amending Chapter 13, Article 13.06, Solid Waste, by adding Section 13.06.034, Subsection (a) through (e) to provide for roll-off containers; providing for providing for roll-off containers on residential lots; providing a permit requirement; providing for permit extensions; prohibiting use by any person other than the owners, permittee or persons contracted to use said roll-off container; providing for a fee to be established by resolution of the city council; by reserving Sections 13.06.035 through 13.06.060; repealing provisions in conflict; providing a severability clause; providing for a penalty not to exceed two thousand dollars ($2,000.00) for each offense; and providing an effective date.

            6) Public Hearing/Discuss and Consider of an application request for the zoning change of 31.917 ± acres located on Snider Lane approximately 900’ east of Shady Lane. The Property is described as Tracts 51 and 60 of Abstract number 477 and Tracts 27 and 44 of Abstract number 893 Collin County Texas. The applicant Louis Gigliotti is requesting a zoning change from the current zoning of Agriculture (AO) to Residential 2 acre (R2). [Monte Carlo Estates]

            7) Discuss and Consider awarding a bid for the construction of 700’ of a 12” waterline along Stinson Road.

            8) A resolution of the City Council of the City of Lucas, Texas endorsing the “JOINT RECOMMENDATION FOR REGIONAL RAIL IN NORTH CENTRAL TEXAS” as approved by the Boards Of Dallas Area Rapid Transit (DART), Denton County Transportation Authority (DCTA) and the Fort Worth Transportation Authority (THE T) that supports the concept of local option funding of public transit in the region by exempting an amount equal to the locally authorized transit sales tax from the 2% local sales tax cap.

            9) Discuss and Consider the Waste Water Master Plan.


            10) Discuss and Consider Wolf Creek Investors LP Final Plat to subdivide the property described as 39.67± acres situated in the Gabriel Fitzhugh Survey, Abstract A0318, Tract 15 in Collin County Texas. Generally located east of FM 1378 (Country Club Road) on Forest Grove Road. [Wolfe Creek Phase II]

            11) Discuss and Consider a Preliminary plat for 47.70± acres situated in the Gabe Fitzhugh Survey Abstract No. 318, and John Kirby Survey Abstract number 506, Collin County Texas. Applicant Byron McCollum of McCollum & Associates is requesting the approval of the preliminary plat. The property is generally located at 1295 W. Forest Grove Road. [The Creeks of Forest Grove]

            12) Discuss and Consider the adoption of an ordinance authorizing and allowing, under the act governing the Texas Municipal Retirement System, Restricted Prior Service Credit to employees who are members of the system for service previously performed for various other public entities for which they have not received credited service; and establishing an effective date for the ordinance.

            13) Discuss and Consider to approve a resolution establishing a Master Fee Schedule for the City of Lucas. [Each fiscal year the City will adopt a schedule of fees for various types of building permits, contractor registration, planning & zoning, utilities, administration and fire permitting]

            14) Discuss and Consider the appointment of five (5) regular commissioners and two (2) alternates commissioners to the Planning & Zoning Commission; five (5) regular members and two (2) alternates members to the Parks and Open Space Board.

 

Executive Session

The City Council may convene in Executive Session in accordance with the Local Government Code. All decisions regarding the discussion of the Executive Session must be made in Open Session.

            15) City Council pursuant to §551.071 of the Texas Government Code may convene into Executive Session regarding the litigation between Buzznet, Inc. and the City of Lucas and lease by and between Buzznet, Inc. and the City of Lucas.

            16) City Council pursuant to §551.072 of the Texas Government Code may convene into Executive Session regarding the purchase, lease, and sale of property.

            17) City Council pursuant to §551.074 of the Texas Government Code may convene into Executive Session to deliberate the duties and assignment of such of the City Administrator, Mayor, and City Council.

            18) Take any action as necessary from the Executive Session.


Routine Business

            19) Discussion and consideration for items to be placed on a future agenda.

            20) Adjournment.

 

As authorized by Section 551.071 (2) of the Local Government Code, the City Council may convene into closed Executive Session for the purpose of seeking confidential legal advice from the City Attorney regarding any item on the agenda at any time during the meeting.
