Notice is hereby given that a Regular Meeting of the City Council of the City of Lucas will be held on Monday, October 16, 2006, at 7:00 PM at the Lucas City Annex, 185 Country Club Road, Lucas, Texas, at which time the following Agenda will be discussed.

Consent Agenda

The Consent Agenda is used to increase the efficiency of time. All items listed under the Consent Agenda may be considered by a single motion, second and passage by a majority vote of the Council present at the time of consideration. Any member of Council may remove an item from the Consent Agenda prior to a motion to act upon the agenda.


3) Consider approval of the minutes from the October 2, 2006 Regular City Council Meeting.

4) Consider approval of an ordinance of the City of Lucas, Collin County, Texas amending the Comprehensive Zoning Ordinance, Chapter 9 of Code of Ordinances, by adding Article 15.5 “ACCESSORY BUILDINGS, STRUCTURES AND USE REGULATIONS”, Sections 9-130 through 9-135, providing regulations for accessory buildings, structures and uses in all zoning districts; by amending various sections of Chapter 9, to wit: Section 9-30, Section 9-35, Section 9-38, Section 9-42, Section 9-43, Section9-52, Section 9-53, Section 9-61, Section 9-70, Section 9-80, Section 9-95, Section 9-101, and Section 9-121 by adding provisions for accessory buildings, structures and uses and/or by amending to comply with Article 15.5 and/or by deleting and reserving for future use; Repealing provisions in conflict; providing a severability clause; providing for a penalty not to exceed two thousand dollars ($2,000.00) for each offense; and providing an effective date.

5) Consider approval of an ordinance of the City of Lucas, Texas, amending the Code of Ordinance by amending CHAPTER 6, “SUBDIVISION AND DEVELOPMENT REGULATIONS,” by amending SECTION 6.402, “PARK SITES,” by repealing Subsection 2 in it’s entirety and replacing the same with new language providing for park land dedication for developments of less than fifty (50) acres and by adding Subsection 3 to provide for park land dedication for development of fifty (50) acres or more; providing a repealing clause; providing a penalty of fine not to exceed the sum of two thousand ($2,000.00) dollars for each offense; providing a severability clause; and providing an effective date.

 

Public Hearings

The Public Hearing agenda is provided for the purpose of allowing citizens to ask specific questions regarding only the subject posted for the Public Hearing. Generally the Public Hearing is required by State Law and a record of those attending the Public Hearing is maintained as part of the official record of the proceedings.

6) Public Hearing/Consideration/Discussion/Action to consider Amendments to the Capital Improvement Plan, Land Use Assumptions and Impact Fees. [2nd Public Hearing, 1st Public Hearing held by the Planning & Zoning Commission acting in the capacity of the Advisory Committee at their October 9th meeting.]

 

Workshop Agenda

7) Consideration/Discussion/Action to consider an application request for a Site Plan consisting of 28.45 ± acres situated in the William Snider Survey Abstract Number 821 Collin County Texas. The applicant Stephen Preston of Sterling CentreCorp Management Services is making application for approval of a Site Plan. The Property is generally located at the NE Corner of FM 2551 and Lucas RD.


8) Discussion on the proposed soccer complex on West Lucas Road east of Cornerstone Baptist Church.

9) Discussion/Action on an application file by the City of Parker on October 3, 2006, to obtain a sewer CCN with the Texas Commission on Environmental Quality to provide sewer utility service in Collin County. The proposed utility service is located approximately 5 miles east of downtown Plano, and is generally bounded on the north by Lucas Road; on the east by Stinson Road; on the south by Curtis Lane; and on the west by FM 2551 (Dillehay Road). The total area being requested includes approximately 766 acres and 278 current customers.

10) Discussion/Action on the date for the Founder’s Day Parade and Staff Christmas party.

11) Discussion/Action on the review of the Animal Control Ordinance regarding further action on issuance of repeated citations. [MPT Fisher]

12) Discussion/Action on Municipal Court fines and alternatives. [CM Carmickle]

13) Discussion/Action on the development of an ordinance regulating dumpsters in residential areas. [MPT Fisher]

14) Discussion/Action of Special Use Permits (SUP) in single family districts.

15) Discussion/Action on a proposed ordinance setting time limits for permits and fee structure. [MPT Fisher]

16) Discussion/Action on a proposed Dark Store ordinance. [CM Peele]

17) Discussion/Action on a proposed commercial big box ordinance. [CM Carmickle]

18) Discussion/Action on maps, data and associated GIS. [CM Zriny]

As authorized by Section 551.071 (2) of the Local Government Code, the City Council may convene into closed Executive Session for the purpose of seeking confidential legal advice from the City Attorney regarding any item on the agenda at any time during the meeting.
