Notice is hereby given that a Regular Meeting of the City Council of the City of Lucas will be held on Thursday, November 16, 2006, at 7:00 PM at the Lucas City Annex, 185 Country Club Road, Lucas, Texas, at which time the following Agenda will be discussed.

Consent Agenda

The Consent Agenda is used to increase the efficiency of time. All items listed under the Consent Agenda may be considered by a single motion, second and passage by a majority vote of the Council present at the time of consideration. Any member of Council may remove an item from the Consent Agenda prior to a motion to act upon the agenda.


3) Consent and approve the minutes from the November 2, 2006 Regular City Council Meeting.

4) Consent and approve a resolution authorizing the Mayor to execute an amendment to an agreement between the City of Lucas and Linebarger Goggan Blair & Sampson, LLP regarding the collection of delinquent taxes.

Public Hearings

The Public Hearing agenda is provided for the purpose of allowing citizens to ask specific questions regarding only the subject posted for the Public Hearing. Generally the Public Hearing is required by State Law and a record of those attending the Public Hearing is maintained as part of the official record of the proceedings.

5) Public Hearing/Consideration/Discussion/Action an ordinance of the City of Lucas, Collin County, Texas amending the Comprehensive Zoning Ordinance, Chapter 9 of Code of Ordinances, by adding Article 27 “Fences and Use Regulations”, providing regulations for fences, and uses in all zoning districts; repealing provisions in conflict; providing a severability clause; providing for a penalty not to exceed two thousand dollars ($2,000.00) for each offense; and providing an effective date.

6) Presentation and update from North Texas Municipal Water District (NTMWD) regarding the drought conditions

7) Discuss and provide direction whether or not to negotiate a proposed Developer’s Agreement with Big Horn Development for property located in the City of Lucas’ (ETJ) Extra-Territorial Jurisdiction. Generally located in the John Gray, George Gunnell, and Lewis Turner Surveys approximately 1200 feet north of the Parker Road and Stinson Road intersection; on the west side of Stinson Road.

8) Presentation/Discussion/Action on property located at the Northeast corner of FM 2551 and West Lucas Road owned by the Sterling Corporation regarding the current site plan and future development of the property.

9) Discussion/Action on an amendment to the Drought Contingency Plan. [Sanders]

10) Consent and approve a resolution to establish a Master Fee Schedule for the City of Lucas. [Each fiscal year the City will adopt a schedule of fees for various types of building permits, contractor registration, planning & zoning, utilities, administration and fire permitting]

11) Discussion/Action on a possible Home Rule Charter. [Sanders]

12) Discussion/Action on the expansion of the Collin County Regional Airport. [Zriny]


13) Discussion/Action on a proposed ordinance limiting the distance sex offenders can live from a school, daycares, churches, parks or any area that children may gather. [Fisher]

14) Discussion/Action of the city’s animal control contract with NTACA to evaluate the overall service provided and discuss their procedure for wild animal capture /removal. [Frazier]

15) Discussion/Action on enacting or rewriting any and all ordinances that apply to truck parking, lighting, landscaping, retail store service hours, and any other pertinent ordinances for the purpose of regulating commercial businesses to minimize nuisance and negative impact on the citizens of Lucas. [Frazier]

16) Discussion/Action on the Economic Development Committee. [Frazier]

17) Discussion/Action to set a date for a Public Hearing regarding an ordinance amending Code of Ordinance, Chapter 13, Article 13.06, Solid Waste, by adding Section 13.06.034, Subsection (a) through (e) to provide for roll-off containers; providing for providing for roll-off containers on residential lots; providing a permit requirement; providing for permit extensions; prohibiting use by any person other than the owners, permittee or persons contracted to use said roll-off container; providing for a fee to be established by resolution of the city council; by reserving sections 13.06.035 through 13.06.060.

Executive Session

The City Council may convene in Executive Session in accordance with the Local Government Code. All decisions regarding the discussion of the Executive Session must be made in Open Session.

18) City Council pursuant to §551.072 of the Texas Government Code may convene into Executive Session regarding the purchase and sale of property.

19) City Council pursuant to §551.071 of the Texas Government Code may convene into Executive Session regarding the potential litigation between Buzznet, Inc. and the City of Lucas.

Regular Agenda

20) Take any action as necessary from the Executive Session.

Routine Business

21) Discussion and consideration for items to be placed on a future agenda.

22) Adjournment.


As authorized by Section 551.071 (2) of the Local Government Code, the City Council may convene into closed Executive Session for the purpose of seeking confidential legal advice from the City Attorney regarding any item on the agenda at any time during the meeting.
